1.General provisions

These Terms and Conditions establish the rules for accessing and using the website camere.md, hereinafter referred to as the "Website".

The website is managed by SBC SMART SRL.

By accessing, browsing or using the Website and its functionalities, the User confirms that he has become aware of these Terms and Conditions and undertakes to use the Website in accordance with them and with the applicable legislation of the Republic of Moldova.

If the User does not agree with these conditions, he must stop using the Website.

These Terms and Conditions relate exclusively to use of the website camere.md.

The conditions regarding the purchase of products, payment, delivery, return, warranty, installation and provision of other services by SBC SMART SRL are regulated separately by commercial conditions, contracts, offers or other applicable documents.

In the continuation of the document, SBC SMART SRL may be referred to "SBC SMART", "Company" or "Website Operator".

3.Definitions

For the purposes of this document:

Website – the online platform camere.md, including the pages, functionalities, tools and content accessible through it.

SBC SMART – SBC SMART SRL, the administrator and operator of the camere.md Website.

User – any natural or legal person who accesses or uses the Website.

Contents – the texts, images, photographs, graphics, design elements, technical information, databases, page structure, interactive elements and other materials available on the Website.

Configurator – the digital tool available through camere.md that allows the User to enter certain information and preferences to obtain recommendations regarding a possible technical configuration.

4.Purpose of the website

The camere.md website has the role of presenting the activity of SBC SMART, the products, solutions and services available, as well as facilitating the interaction between the User and the Company.

Through the Website, the User can, depending on the available functionalities:

a) consult information about products and technical solutions;

b) consult the characteristics of the products;

c) use the Configurator;

d) compare or select certain products or features;

e) generate a preliminary technical configuration;

f) request additional information;

g) submit data through the available forms;

h) request to be contacted by SBC SMART;

i) access other digital functionalities made available by the Company.

SBC SMART may add, modify, suspend or eliminate certain functionalities of the Website depending on the technical and commercial evolution of the platform.

5.Right of use

SBC SMART grants the User a limited, non-exclusive, non-transferable and revocable right to use the Website for legitimate personal or professional purposes, in accordance with its intended purpose.

The user can consult and use the public information available on the Website for the purpose of informing about the products and services presented.

The use of the Website does not give the User any ownership rights over the Website, software, databases, Content or other elements belonging to SBC SMART or its partners.

6.Obligations of the user

The user undertakes to use the Website legally and in good faith.

The User shall not:

• use the Website for illegal, fraudulent or abusive activities;
• attempt to gain unauthorized access to the Website, servers, databases or related systems;
• attempt to identify or exploit security vulnerabilities;
• disrupt or attempt to disrupt the normal operation of the Website;

When using forms, the Configurator or other interactive Functionalities, the User is responsible for the accuracy of the information provided.

The User must not transmit through the Website:

• malicious content;
• data of third parties that it does not have the right to transmit;
• information that infringes the rights of third parties;
• illegal content.

SBC SMART may use the information provided through the Website for the purposes for which it was submitted, in accordance with applicable law and the Privacy Policy.

8.CAMERE.MD configurator

The configurator is a digital functionality of the Website designed to simplify the process of identifying equipment or technical solutions suitable for the requirements declared by the User.

The configurator can use information such as:

• object type;
• type of zones;
• the approximate dimensions or peculiarities of space;
• the number or type of cameras;
• storage requirements;
• the way of feeding;
• other options selected by the User.

Based on these, the Website can automatically generate a recommendation, a list of equipment, a configuration or an estimate.

8.1. The nature of the recommendations

The results generated by the Configurator have informative and preliminary and is based on the information entered by the User and the technical rules implemented in the system.

The result of the Configurator does not constitute, by itself:

• a definitive technical project;
• a technical expertise;
• an on-site finding;
• a warranty on the possibility of installation under any conditions;
• a definitive contractual commitment from SBC SMART.

Additional verification of the configuration or actual site conditions may be required for certain projects.

8.2. Correctness of information

The quality of the recommendation generated by the Configurator also depends on the correctness of the data provided by the User.

SBC SMART cannot guarantee the accuracy of a result generated based on incorrect, incomplete or approximate information entered by the User.

8.3. Estimates shown

The values, quantities, configurations or prices presented in the Configurator may be approximate when this is indicated on the Website or results from the nature of the information requested.

Commercial and contractual conditions regarding the purchase of products or services are regulated separately.

9.Information about products and services

SBC SMART makes reasonable efforts to ensure that the information available on camere.md is correct, relevant and up-to-date.

However, certain information may change over time as a result of:

• manufacturer updates;
• modification of technical specifications;
• the appearance of new versions;
• availability change;
• updating the Website.

Photographs, renderings, illustrations and other visual representations of products are for informational purposes only.

There may be differences between the visual representation on the Website and the exact appearance of the product, especially as a result of changes made by the manufacturer.

SBC SMART can at any time correct obvious errors in writing, display, specification or operation of the Website.

10.Informational content

The technical information, articles, recommendations, explanations and other materials published on the Website are provided mainly for informational purposes.

They should not automatically be interpreted as an individualized technical project or professional advice adapted to all the circumstances of a concrete case.

If a solution requires the analysis of the specific conditions of an object, SBC SMART can recommend its verification by a specialist.

11.Intellectual property

Except where otherwise indicated, the Website and its original elements are the property of SBC SMART or are used by it under a legal right.

• application architecture and logic;
• software code;
• the texts;
• graphic materials;
• own photos;
• the illustrations;
• iconography;

• the structure and organization of the Content.

It is prohibited, without the prior authorization of the rights holder, to the extent that the legislation does not allow otherwise:

In case of identifying a possible security vulnerability of camere.md, the User is encouraged to inform SBC SMART and not to exploit that vulnerability.

16.Accounts and Authentication

If the Website currently allows or will allow in the future the creation of an account, the User is responsible for:

• keeping credentials confidential;
• using a strong password;
• the activities carried out through his account;
• notify SBC SMART if it suspects unauthorized access to the account.

The user must not allow abusive or unauthorized use of the account.

SBC SMART may temporarily suspend access to an account when there are reasonable grounds for its security.

17.Protection of personal data

As part of the operation of camere.md, SBC SMART can process personal data of Users.

Temeiurile pe care SBC SMART prelucrează date sunt cele prevăzute de lege: executarea contractului (comenzi, montaj, garanție), consimțământul (comunicări comerciale), obligația legală (evidență contabilă și fiscală) și interesul legitim (securitatea website-ului, prevenirea fraudei).

Utilizatorul are dreptul de acces, rectificare, ștergere, restricționare a prelucrării, portabilitate a datelor și opoziție, inclusiv opoziție la marketing direct. Cererile se soluționează gratuit, în termen de o lună de la primire; în cazuri complexe termenul poate fi prelungit cu cel mult două luni, Utilizatorul fiind informat în prima lună despre prelungire și motivele ei.

În cazul unei încălcări a securității datelor, SBC SMART notifică CNPDCP în termen de 72 de ore de la momentul în care a luat cunoștință de aceasta, iar atunci când încălcarea prezintă un risc ridicat pentru drepturile persoanelor, le informează și pe acestea.

Transferurile de date către alte state se fac numai cu garanțiile prevăzute de lege, inclusiv clauze contractuale standard atunci când statul destinatar nu asigură un nivel adecvat de protecție.

The Privacy Policy is part of the legal framework regarding the use of the Website, but is made available to the User separately for clear and transparent information.

18.Cookies and similar technologies

Cookie-urile care nu sunt strict necesare funcționării se folosesc numai după un consimțământ liber exprimat, printr-o acțiune neechivocă. Casetele pre-bifate nu constituie consimțământ valabil. Bannerul de pe Website oferă, la același nivel, opțiunile de acceptare, de respingere și de configurare, iar consimțământul poate fi retras oricând, la fel de ușor cum a fost acordat.

Comunicărilor comerciale li se aplică și Legea nr. 284/2004 privind comerțul electronic.

19.Limitation of liability regarding the website

SBC SMART makes reasonable efforts to maintain the accuracy, security and operation of the Website.

To the extent permitted by applicable law, SBC SMART cannot be held liable for damages caused solely by circumstances beyond its control, such as:

• interruption of the User's connection to the Internet;
• failure of the User's device;
• local browser or software incompatibilities;
• external services managed by third parties;
• improper use of the Website;
• incorrect information entered by the User;
• unauthorized access caused by the compromise of the User's credentials;
• cases of force majeure or other circumstances for which SBC SMART is not liable according to law.

Nothing herein shall exclude or limit SBC SMART's liability where such exclusion or limitation is prohibited by law.

20.Suspension or restriction of access

SBC SMART may restrict or suspend a User's access to certain Functionalities when there are reasonable grounds to believe that:

• The website is used illegally;
• there is an attempted fraud;
• there is a risk to the security of the Website;
• User attempts to compromise infrastructure;
• the rights of SBC SMART or third parties are infringed;
• are in serious breach of these Terms and Conditions.

The measures applied will be proportionate to the nature and gravity of the situation, when the circumstances allow it.

21.Modification of the website

SBC SMART may modify, develop or remove certain elements of the Website, including:

• structure;
• interface;
• The configurator;
• functionalities;
• the categories;
• search and filter systems;
• the content;
• technical mechanisms.

SBC SMART is not obligated to permanently maintain all functionality existing at any given time.

The modification of the Website does not affect the rights already acquired by the User within separate contractual relationships.

22.Modification of terms and conditions

SBC SMART may update these Terms and Conditions when necessary, including as a result of:

• modification of the Website;
• the introduction of new functionalities;
• amending the legislation;
• change in technical or security requirements;
• clarification of the rules of use.

The updated version will be published on camere.md.

The date of the last update will be indicated at the top of the document.

Continued use of the Website after the publication of changes is subject to the version in force at the time of use, without affecting the rights already acquired through previous contractual relationships.

23.Applicable law

Prezentele Termeni și Condiții sunt guvernate de legislația Republicii Moldova, în special:

• Codul civil al Republicii Moldova — încheierea și executarea contractelor, inclusiv la distanță;
• Legea nr. 105/2003 privind protecția consumatorilor;
• Legea nr. 284/2004 privind comerțul electronic;
• Legea nr. 195/2024 privind protecția datelor cu caracter personal, în vigoare din 23 august 2026;
• Legea nr. 231/2010 privind comerțul interior.

Drepturile imperative pe care legislația le acordă consumatorilor — între care dreptul de retragere din contractele încheiate la distanță și termenele de garanție — se aplică în orice caz și nu pot fi restrânse prin prezentul document.

Any disagreement regarding the use of the Website will be resolved, as far as possible, amicably.

If an amicable settlement is not possible, the dispute will be resolved according to the legislation of the Republic of Moldova and the legal norms regarding jurisdiction.

No provision of this document limits the imperative rights granted by law to the persons who benefit from them.

24.Partial nullity

If one of the provisions of these Terms and Conditions is declared void, unenforceable or illegal, this situation will not affect, to the extent permitted by law, the validity of the other provisions.

That provision shall be interpreted or superseded to the extent necessary to produce an effect as close as possible to its legitimate purpose in accordance with applicable law.
